PART 1: GOWN OWNER CONSIGNMENT & RENTAL AGREEMENT
Effective Date: March 25, 2026
BETWEEN: Own This Outfit (the “Company”)
AND: The Gown Owner (the “Consignor”)
This Consignment & Rental Agreement (the “Agreement”) sets forth the terms and conditions under which the Consignor agrees to list luxury formal or wedding gowns (the “Property”) with Own This Outfit for the purpose of third-party rentals.
Note: This includes the Tiered Revenue Split (60/40 for gowns under $5k and 70/30 for gowns $5k+), 6-month minimum listing, and 3-5 day listing timeline.

PART 2: RENTER PROTECTION & DAMAGE WAIVER DISCLOSURE
Effective Date: March 25, 2026
This Disclosure outlines the terms of the mandatory $10.00 Protection Fee. Coverage includes “Normal Wear and Tear” (minor stains, small seam repairs). Major damage, theft, or failure to return the gown remains the liability of the Renter for the full replacement value.

PART 3: MARKETPLACE TERMS OF SERVICE

OWN THIS OUTFIT – GOWN OWNER CONSIGNMENT & RENTAL AGREEMENT

EFFECTIVE DATE: March 25, 2026
BETWEEN: Own This Outfit (the “Company”)
AND: The Gown Owner (the “Consignor”)

This Consignment & Rental Agreement (the “Agreement”) sets forth the terms and conditions under which the Consignor agrees to list luxury formal or wedding gowns (the “Property”) with Own This Outfit for the purpose of third-party rentals.


1. THE PARTNERSHIP: CONSIGNMENT AND APPOINTMENT

By listing your gown with Own This Outfit (“the Company”), you agree to enter into a consignment-for-rental partnership. The Consignor hereby grants Own This Outfit the exclusive right to list, market, and rent the Property through the Company’s peer-to-peer rental marketplace. You retain ownership of the gown while authorizing the Company to manage the rental process, including marketing, logistics, and professional cleaning. The Consignor retains legal title to the Property until such time as the Property is sold (if applicable) or this Agreement is terminated.

2. REVENUE SHARE

For each successful rental transaction completed through the Company’s platform, the revenue share is based on the Gross Rental Revenue and shall be distributed as follows:

  • Standard 60/40 Split (MSRP under $5,000): For gowns with an Original Retail Price (MSRP) of less than five thousand dollars ($5,000), the Consignor shall receive sixty percent (60%) of the Gross Rental Revenue, and Own This Outfit shall retain forty percent (40%) of the Gross Rental Revenue.
  • Platinum 70/30 Split (MSRP $5,000 or more): For gowns with an Original Retail Price (MSRP) of five thousand dollars ($5,000) or more, the Consignor shall receive seventy percent (70%) of the Gross Rental Revenue, and Own This Outfit shall retain thirty percent (30%) of the Gross Rental Revenue.

3. LOOK STUNNING, DO GOOD (CHARITABLE IMPACT)

Own This Outfit is committed to making an impact. A portion of the Company’s forty percent (40%) share from every rental is donated to our rotating charitable partners, supporting women’s empowerment and sustainable fashion initiatives. This donation is made from the Company’s share and does not reduce the Consignor’s 60% payout.

4. LOGISTICS, MAINTENANCE, AND CARE

The Company agrees to provide professional handling for all consigned items:

  • Receipt Confirmation: Upon physical receipt of the Property, the Company will send a confirmation via email or text message to the Consignor.
  • Listing Timeline: The Company aims to list the Property on the Company’s platform within three to five (3-5) business days of receipt. The Consignor acknowledges that this timeline is an estimate for high-quality listing preparation and may be extended due to high volume, delivery delays, or additional quality control requirements.
  • Owner Cleaning Requirement: Prior to shipping, the Consignor must ensure the Property has been professionally cleaned and is free of visible stains or odors.
  • Company Maintenance: Upon arrival, the Company will perform a secondary inspection and may re-clean and/or professionally steam the Property to ensure it meets the Company’s “bridal-ready” standards before listing.
  • Inspection: Every gown is inspected and quality-checked before and after each rental period.
  • Maintenance: The Company provides professional steaming and minor spot cleaning to ensure the Property is “bridal-ready” for every user.
  • Shipping: The Company manages all shipping logistics using specialized protective packaging and prepaid return labels.

5. NORMAL WEAR AND TEAR POLICY

The Consignor acknowledges and accepts that by offering a gown for rental through Own This Outfit, the gown will be subjected to professional use, which may result in “Normal Wear and Tear.” Normal Wear and Tear is defined as minor cosmetic imperfections that do not affect the overall aesthetic or structural integrity of the gown for future rentals. This includes, but is not limited to:

  • Minor snags, loose threads, or missing beads/sequins.
  • Slight stretching of delicate fabrics.
  • Minor scuffing at the hemline.
    Own This Outfit shall not be held liable for such minor cosmetic imperfections. The Company remains committed to maintaining the highest quality standards and will provide professional cleaning, steaming, and quality-controlled inspections before and after every rental to minimize and manage the effects of use.

6. GOWN CONDITION & MAINTENANCE

  • Normal Wear and Tear: The Consignor acknowledges that repeated rentals may result in “Normal Wear and Tear,” including minor snags, loose threads, or small hemline dust, which are inherent to the rental industry.
  • Maintenance: The Company ensures every gown is professionally inspected and steamed before and after every rental. While the Company takes every precaution, Normal Wear and Tear is expected.
  • Damage Beyond Repair: If the Property is damaged beyond repair or lost while in the possession of a renter, the Company will utilize the Renter Protection Fee and/or security deposits to compensate the Consignor based on the gown’s current rental valuation, subject to the limitations of the Company’s internal insurance policy.

7. CONSIGNOR REPRESENTATIONS AND WARRANTIES

The Consignor represents and warrants that:

  1. They are the sole legal owner of the Property and have the full right to consign it.
  2. The Property is authentic and matches the designer and brand descriptions provided.
  3. The Property is delivered to the Company in excellent condition, free of permanent stains, odors, or structural defects, unless otherwise disclosed in writing.

8. EXCLUSIVITY & TERMINATION

  • Minimum Listing Period: To ensure availability for customers, the Company requests a minimum six (6) month listing period.
  • Withdrawal: The Consignor may request the return of the Property at any time by providing thirty (30) days’ written notice, provided there are no pending future bookings.
  • Future Bookings: The Company cannot return the Property until all existing future rental reservations for the Property have been fulfilled.

9. RENTER PROTECTION ($10.00)

All rentals are protected by our mandatory $10.00 Renter Protection & Damage Waiver (fee subject to change at the Company’s discretion), which covers minor accidental wear and tear, ensuring both the Renter and the Gown Owner are protected against minor incidents.

10. LIMITATION OF LIABILITY

Own This Outfit shall exercise reasonable care in handling the Property but shall not be held liable for inherent fabric degradation or damage resulting from cleaning processes required to maintain the gown’s rental standards.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

Peer-to-Peer Rental Marketplace Terms of Service

Welcome to Own This Outfit (the “Platform”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Own This Outfit (“OTO,” “we,” “us,” or “our”). By accessing ownthisoutfit.com or utilizing our rental services, you agree to be bound by these Terms.

Own This Outfit operates a luxury fashion marketplace that facilitates the rental of high-end formal and wedding gowns between gown owners (“Owners”) and individuals seeking to rent such attire (“Renters”).


1. DEFINITIONS

  • Platform: The website ownthisoutfit.com and all associated services.
  • Gown: Any dress, formal wear, or accessory listed for rent on the Platform.
  • Owner: A User who lists their personal gown on the Platform to earn residual income.
  • Renter: A User who reserves and pays to wear a Gown for a designated period.
  • Rental Period: The specific window of time for which a Gown is booked.

2. THE MARKETPLACE MODEL

OTO is a peer-to-peer marketplace platform that facilitates rentals between Gown Owners and Renters. OTO is not the owner of listed Gowns (unless expressly stated in a specific listing) and does not transfer ownership of any Gown. Owners list Gowns, Renters reserve and rent Gowns, and OTO provides the marketplace infrastructure, including listing tools, quality control processes, professional steaming, logistics coordination, customer support, and payment processing.

No Employment/Agency Relationship. Unless expressly agreed in writing, OTO is not an agent, partner, joint venturer, or insurer of any User, and does not create a fiduciary duty to any User. Owners and Renters interact at arm’s length and are solely responsible for their own conduct and compliance with applicable laws.

Platform Role; User Disputes. OTO may assist with dispute intake and resolution as described in these Terms, but OTO does not guarantee the performance, conduct, or suitability of any User, and does not guarantee that a Gown will meet a particular expectation beyond the standards described in these Terms and on the Platform.

While OTO facilitates the transaction, the Gown remains the property of the Owner unless otherwise specified.


3. OWNER TERMS & RESIDUAL INCOME

By listing a Gown on the Platform, the Owner agrees to the following:

  • Authenticity, Accurate Listing, and Condition Requirements: Owners must provide accurate descriptions and high-resolution photographs. Gowns must be authentic designer pieces in excellent condition. At a minimum, each listed Gown must be: (i) structurally sound (no broken zippers, missing closures, or unsafe elements), (ii) free of significant stains, odors (including smoke, mildew, or strong fragrance), and visible damage, (iii) professionally cleaned prior to initial intake if requested by OTO, and (iv) stored and delivered to OTO (or OTO’s designated facility) in a protective manner. OTO may, in its discretion, decline, delist, or pause any listing that does not meet Platform standards.

  • Residual Income; Payout Schedule (Net 30): Owners shall receive a percentage of the rental fee (the “Payout”) for every successful completed rental. Unless otherwise stated in the Owner Dashboard for a particular program, Payouts are issued net thirty (30) days from the date the rental is deemed completed (generally when the Gown is returned, received, and checked in by OTO and any applicable damage/late assessments are finalized). Payout rates, any service fees, and the method of payment are detailed in the Owner Dashboard and may be updated from time to time.

  • Taxes; Information Reporting (Including 1099-K): Owners are solely responsible for determining and paying any and all federal, state, and local taxes arising from amounts paid to them through the Platform. OTO may collect and report tax information as required by law and may issue or facilitate issuance of applicable information returns (including, where required, Form 1099-K) based on payment processor reporting rules and legal thresholds. Owners agree to provide complete and accurate tax documentation (e.g., W-9) upon request and acknowledge that failure to do so may result in backup withholding, payout delays, or suspension of listings.

  • Exclusivity: While a Gown is listed with OTO, the Owner may not rent the piece independently or through competing platforms without prior written notice and removal of the listing.

  • Risk of Wear: Owners acknowledge that repeated rentals involve a risk of “normal wear and tear.” OTO is not liable for minor degradation of fabric over time.


4. RENTER TERMS & OBLIGATIONS

By renting a Gown, the Renter agrees to:

  • Payment: Pay the full rental fee, including any applicable security deposits, at the time of booking.

  • Rental Duration; Rental Period Controls: Your rental is for the Rental Period shown at checkout and in your order confirmation. You may not extend, swap, or transfer your reservation without OTO’s prior approval. Wearing the Gown outside the Rental Period, failing to ship it back on time, or otherwise retaining possession beyond the Rental Period may result in late fees and/or additional charges as described in these Terms.

  • Reservation Policy: A reservation is not guaranteed until payment is successfully processed and you receive a confirmation from OTO. OTO may cancel or modify a reservation if a listing becomes unavailable due to quality control issues, shipping issues, or other operational constraints; in such cases, OTO will work with you to provide a substitute or an appropriate refund/credit consistent with Section 8.

  • Usage: Treat the Gown with the utmost care. You are prohibited from making any alterations (permanent or temporary) to the Gown.

  • Shipping/Return Requirements: You must (i) keep all original packaging and included components (e.g., garment bag, straps, belts, detachable items, accessories if included), (ii) return the Gown in the provided protective packaging using the prepaid shipping label, and (iii) drop off the return with the designated carrier by the date specified in the order (and in accordance with carrier cutoff times). Failure to return the Gown on time will result in late fees of $50 per day.

  • Address and Delivery Acceptance: You are responsible for providing an accurate and secure delivery address and retrieving the package promptly. If you redirect, hold, or otherwise modify delivery with the carrier, you assume additional risk of delay or loss.


5. SHIPPING AND LOGISTICS

  • Delivery: OTO uses third-party carriers. We strive to ensure Gowns arrive at least one day prior to the event date.
  • Prepaid Returns: Every rental includes a prepaid return shipping label. Renters must drop off the Gown at the designated carrier location by the final day of the Rental Period.
  • Risk of Loss: The risk of loss passes to the Renter upon delivery and remains with the Renter until the Gown is scanned by the return carrier.

6. QUALITY ASSURANCE AND CLEANING

  • Inspection: Every Gown undergoes a professional inspection and steaming process by OTO before being dispatched to a Renter to ensure it is “bridal-ready.”

  • OTO-Managed Professional Cleaning Only (No Self-Cleaning): OTO handles professional cleaning for all rentals. Users must NOT attempt to clean, wash, dry clean, steam, iron, spot-treat, soak, or use stain removers on any Gown (including DIY kits, bleach, detergents, or any home remedies). Attempted cleaning can permanently damage fabrics and finishes and may result in damage fees. The rental fee includes professional dry cleaning managed by OTO after each use.


7. DAMAGE, LOSS, AND THEFT

  • Normal Wear vs. Minor Damage vs. Major Damage: Wear consistent with ordinary use for a single event may occur and is considered “normal wear and tear.” However, the following are examples of damage beyond normal wear:

  • Minor Damage (repairable): small seam pulls, minor bead loss, small snags, minor hem issues, replaceable buttons/hooks, light makeup transfer, or other issues that can be professionally repaired/treated without replacement of major sections. If minor damage is present, the Renter authorizes OTO to charge the reasonable cost of repair/restoration (including labor, materials, and shipping/handling if applicable).

  • Major Damage (significant/structural): large tears, significant seam failures, broken zippers that require replacement, heavy or set-in stains (including wine, oil, self-tanner), burns, water damage, permanent odor, missing components that materially affect wearability (e.g., missing straps/belts if essential), or damage requiring extensive panel replacement or reconstruction. For major damage, the Renter authorizes OTO to charge the full cost of repair/restoration, and if repair is not feasible or would exceed the applicable threshold determined by OTO, the item may be treated as a total loss.

  • Repair Fees and Authorization to Charge: You authorize OTO to charge the payment method on file for any repair, restoration, replacement component costs, additional shipping/handling, and administrative processing related to damage or missing items. OTO may, in its discretion, provide documentation (e.g., photos, professional repair estimates), but is not required to obtain multiple estimates.

  • Total Loss (Lost/Stolen/Irreparable): If a Gown is lost, stolen, not returned, or damaged beyond repair, the Renter is liable for the full retail replacement value of the Gown (or, if a replacement is not available, an amount determined by OTO in good faith based on comparable replacement value), plus any applicable taxes and fees. This includes situations where a package is marked delivered but is not retrieved, is stolen after delivery, or is sent back without a carrier scan.

  • Theft and Police Reports: OTO may request that the Renter file a police report and/or provide additional documentation for theft claims. Failure to cooperate may result in the charge being assessed as a total loss.

  • Owner Compensation: In the event of total loss or irreparable damage caused by a Renter, OTO will work to compensate the Owner based on the Gown’s current market value, minus applicable fees.


8. CANCELLATIONS AND REFUNDS

  • Renter Cancellations: Cancellations made more than 30 days before the Rental Period may receive a full refund or store credit. Cancellations made within 30 days are subject to a cancellation fee.
  • Fit Policy: If a Gown does not fit, the Renter must contact OTO within 12 hours of delivery. We will attempt to provide a replacement style; however, refunds are not guaranteed for fit issues if our “Perfect-Fit Guidance” was not utilized.

9. INTELLECTUAL PROPERTY

All content on the Platform, including logos, designs, and text, is the property of Own This Outfit. Owners grant OTO a non-exclusive, royalty-free license to use gown images for marketing and promotional purposes.


10. LIMITATION OF LIABILITY

Own This Outfit provides the Platform on an “as is” basis. We are not responsible for any indirect, incidental, or consequential damages arising from the use of the Platform or the rental of Gowns. Our total liability to any User shall not exceed the total amount paid by the User to OTO in the three months preceding the claim.

Platform Liability Regarding Physical Condition; No Warranties by OTO. To the maximum extent permitted by law, OTO disclaims all warranties, express or implied, regarding the condition, quality, safety, fit, merchantability, or fitness for a particular purpose of any Gown listed by an Owner. OTO’s quality checks, inspections, steaming, and cleaning coordination are operational services and do not create any warranty or guarantee beyond what is expressly stated in these Terms.

User-to-User Disputes. Disputes between Owners and Renters (including disputes about condition, damage responsibility, and replacement value) are primarily between those Users. OTO may, but is not obligated to, facilitate communications, request information, or make a good-faith determination for purposes of administering charges, credits, payouts, delisting, or account actions under these Terms. Users agree to cooperate with reasonable requests for information (including photos and statements) in connection with any dispute.


11. GOVERNING LAW

これらの Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts located in the Commonwealth of Virginia.

CELEBRITY COLLECTION CONSIGNMENT AGREEMENT

  1. SCOPE: This agreement applies specifically to the Celebrity Collection. These high-value or iconic gowns are subject to enhanced security and specialized handling.

  2. REVENUE & CHARITY SPLIT (70/30):

  • 60% to the Owner/Charity: Due to the high-profile nature of these gowns, 60% of the rental fee is paid out. Many of our Celebrity partners choose to donate this entire portion to a specific charity of their choice.
  • 30% to Own This Outfit: Covers specialized vault storage, high-value insurance, and priority concierge handling.
  1. PUBLICITY: By participating in the Celebrity Collection, the owner grants Own This Outfit the right to use their likeness and the gown’s history for marketing the “Look Stunning, Do Good” campaign.

Peace of Mind for Your Special Night:
For a flat fee of $10.00, our Renter Protection covers you for accidental “Normal Wear and Tear.” This includes minor snags, small spills, or a stuck zipper.

What’s Covered:

  • Minor stains removable by professional dry cleaning.
  • Small seam repairs or loose beads.

What’s NOT Covered:

  • Theft or loss of the gown.
  • Irreparable damage (e.g., large rips, burns, or permanent red wine/oil stains that ruin the gown).
  • Failure to return the gown.

If the gown is returned with damage exceeding “Normal Wear and Tear” and you did not opt for Renter Protection, you may be liable for the full cost of repair or the gown’s retail replacement value.“
